NOVACHROME — TERMS OF SERVICE

OVERVIEW
Welcome to NOVACHROME.
These Terms of Service govern your use of the NOVACHROME website, online store, products and related services (the “Services”).
Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer products and Services to you.
By accessing or using the Services, or placing an order with us, you agree to these Terms of Service together with any policies referred to in them, including our Privacy Policy and Returns & Refund Policy.
Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.
AUSTRALIAN CONSUMER LAW
Our goods come with consumer guarantees that cannot be excluded under the Australian Consumer Law.
Depending on the circumstances, if goods fail to meet a consumer guarantee you may be entitled to a repair, replacement, refund, cancellation or compensation.
For a major failure, consumers may generally choose between a refund or replacement and may also be entitled to compensation for reasonably foreseeable loss or damage.
Nothing in these Terms is intended to limit those rights. ACCC
1. ACCESS AND ACCOUNTS
You may browse our store without creating an account.
If you create an account or provide information through the Services, you agree to provide information that is accurate, current and complete.
You are responsible for maintaining the confidentiality of your account credentials and for activity undertaken through your account.
You must not use the Services for unlawful, fraudulent or malicious purposes.
2. PRODUCTS
We make reasonable efforts to present our products accurately, including their appearance, dimensions, materials and features.
However, colours, reflections and appearance may vary slightly depending on lighting, photography, screen settings and the device you use.
This does not limit your rights where goods do not match their description, are not of acceptable quality or otherwise fail to satisfy an applicable consumer guarantee.
Product availability may change without notice.
We may discontinue or change products from time to time.
3. ORDERS
When you submit an order, you are offering to purchase the products shown in your order.
Your order is accepted when we confirm it or otherwise begin processing it for fulfilment.
We may decline or cancel an order where there is a legitimate reason to do so, including:
- Product unavailability
- An obvious pricing or listing error
- Suspected fraud or unauthorised payment activity
- Inability to deliver to the address supplied
- A breach of these Terms
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled products.
Please check your order details carefully before placing your order.
Cancellation requests are handled in accordance with our Returns & Refund Policy.
4. PRICES AND PAYMENT
Unless otherwise stated, prices on our Australian store are displayed in Australian dollars (AUD).
NOVACHROME is not currently registered for GST, so GST is not added to the price of your order.
Prices may change from time to time, but changes will not affect an order that has already been accepted.
Any applicable shipping charges will be displayed before you complete checkout.
You agree to provide accurate and authorised payment information.
Payments are processed through Shopify and applicable third-party payment providers.
5. SHIPPING AND DELIVERY
We currently ship to Australia and New Zealand.
Orders are generally dispatched within 1–3 business days.
Estimated delivery times displayed by NOVACHROME are estimates rather than guaranteed delivery dates unless we expressly state otherwise.
Our current typical delivery estimate is approximately 10–16 business days from order, although some orders may arrive sooner or later depending on destination, carrier processing, customs and other circumstances.
If your order is significantly delayed, lost or arrives damaged, contact hello@novachrome.co and we will assist you.
Your rights under the Australian Consumer Law are not affected by estimated delivery times or this section.
For New Zealand orders, customs, import duties or other charges may apply depending on the circumstances. Where such charges are imposed directly by New Zealand authorities or carriers and are not expressly included by NOVACHROME at checkout, they may be payable by the recipient.
6. RETURNS, REFUNDS AND CANCELLATIONS
Returns, refunds, exchanges and cancellation requests are governed by our Returns & Refund Policy.
That policy operates in addition to your rights under the Australian Consumer Law.
We do not impose a blanket “no refunds” rule for faulty goods, and nothing in our returns policy limits statutory consumer guarantees. ACCC
7. INTELLECTUAL PROPERTY
Unless otherwise stated, the content made available through NOVACHROME, including branding, product photography, graphics, text, layouts, logos and other original material, is owned by or licensed to NOVACHROME.
You may access and use the website for personal, non-commercial purposes.
You must not reproduce, distribute, republish, commercially exploit or substantially copy NOVACHROME content without permission, except where permitted by law.
Third-party trademarks and intellectual property remain the property of their respective owners.
8. THIRD-PARTY SERVICES
Our Services may rely on third-party providers, including Shopify, payment providers, fulfilment providers, delivery companies, analytics services and other technology providers.
Those providers may have their own terms and privacy policies.
NOVACHROME is responsible for its own obligations to customers and does not seek to avoid those obligations merely because a third-party service provider is involved.
9. SHOPIFY
Our online store is hosted using Shopify.
Shopify provides the ecommerce infrastructure used to operate our store, but purchases made from NOVACHROME are transactions between you and NOVACHROME.
Your use of Shopify-powered functionality may also involve processing under Shopify's own terms and privacy practices.
10. PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Some information is also processed by Shopify and other service providers involved in operating the store.
Where the Privacy Act 1988 (Cth) or other applicable privacy legislation applies to us, we will comply with those requirements.
11. REVIEWS, FEEDBACK AND USER CONTENT
If you submit a review, photograph, suggestion, comment or other content to NOVACHROME, you retain ownership of any intellectual property rights you already hold in that content.
You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for purposes reasonably connected with operating, promoting and improving NOVACHROME.
You represent that you have the right to provide the content and that it does not unlawfully infringe another person's rights.
We may remove content that is unlawful, misleading, abusive, defamatory, infringing, fraudulent or otherwise inappropriate.
12. ERRORS AND AVAILABILITY
Occasionally our website may contain typographical errors, incorrect pricing, inaccurate descriptions or availability errors.
We may correct genuine errors when identified.
If an error affects an order you have already placed, we will contact you where reasonably practicable.
If we cannot fulfil the order as placed and cancel it, we will refund the affected amount.
13. PROHIBITED USES
You must not use the Services to:
- Break the law
- Commit fraud
- Infringe intellectual property rights
- Harass or harm others
- Distribute malware
- Attempt unauthorised access to systems or accounts
- Interfere with the operation or security of the Services
- Collect other people's personal information unlawfully
- Impersonate another person
- Use automated systems in a manner that materially disrupts the Services or breaches applicable technical restrictions
We may take reasonable steps to prevent misuse of the Services.
14. SUSPENSION OR TERMINATION
We may suspend or restrict access to an account or the Services where reasonably necessary, including where we reasonably believe there has been fraud, unlawful activity, security abuse or a material breach of these Terms.
Termination does not affect rights or obligations that accrued before termination.
15. WEBSITE AVAILABILITY
We aim to keep the Services available and accurate but do not guarantee that the website will always be uninterrupted or error-free.
Maintenance, outages, technical failures and third-party service interruptions may occur.
Nothing in this section limits any guarantee or right that cannot legally be excluded.
16. LIABILITY
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including rights and remedies available under the Australian Consumer Law.
To the extent permitted by law, NOVACHROME is not responsible for losses that:
- Were not reasonably foreseeable
- Were caused by circumstances outside our reasonable control
- Result from misuse of the Services or products contrary to instructions
- Arise from information or materials supplied by third parties that we do not control
Any limitation in these Terms is subject to applicable consumer law.
I would not include the previous blanket clause saying liability is capped at the amount paid for the product in every circumstance. Consumer guarantees cannot simply be contracted away. ACCC
17. THIRD-PARTY LINKS
Our website may contain links to third-party websites.
We do not control those websites and are not responsible for their content, availability or privacy practices.
You should review the relevant third party's terms and policies before using its services.
18. SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, that provision will be read down or severed to the extent necessary, while the remaining provisions continue to operate.
19. NO WAIVER
If we do not immediately enforce a right under these Terms, that does not mean we have waived that right.
20. GOVERNING LAW
These Terms are governed by the laws applicable in Queensland, Australia.
You and NOVACHROME submit to the non-exclusive jurisdiction of the courts of Queensland and courts entitled to hear appeals from those courts.
Nothing in this section prevents a consumer from exercising rights available under the Australian Consumer Law or other applicable law.
21. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our Services, business operations or legal obligations.
The updated Terms will be published on this page with a revised Last updated date.
Changes will not retrospectively remove rights that have already accrued.
